The Impact of ICWA Courts: Approaches to Improving Outcomes for Indian Families

ICWA Courts are specialty courts that have improved legal compliance and implementation of the spirit of the law in their respective jurisdictions through focused state-tribal partnerships. ICWA stands as the “gold standard in child welfare,” with active efforts to prevent removal and ensure reunification at the center of this important law. There are now 25 ICWA Courts nationwide using meaningful Tribal collaboration and cultural humility with Indian families to improve outcomes and sustain connections. In this presentation, attendees will learn about ICWA Courts, data outcomes, and how Tribal advocacy has impacted permanency outcomes for Tribal families in ICWA Court jurisdictions. Attendees will also understand how a state-tribal partnership team approach can improve relationships among all those working to improve outcomes for Tribal families.
Presented by: Sheldon Spotted Elk is the Senior Director of Judicial and National Engagement at Casey Family Programs. He has a background in tribal law and presents regularly on child welfare and the ICWA.
He is currently a judge on the Ute Indian Tribe Court of Appeals (Fort Duchesne, Utah), in which jurisdiction he once represented children in child welfare and juvenile delinquency matters. He has also worked as an adjunct professor teaching a law school course on Family Law in Indian Country.
He was recognized as an NCAIED 40 Under 40 recipient, a prestigious award that recognizes 40 emerging American Indian leaders from across Indian Country. He has published an influential law review article on tribal constitutional reform and authored articles on the ICWA.
Sheldon is a graduate of the University of New Mexico School of Law and received a Certificate in Federal Indian Law. He and his two sons are members of the Northern Cheyenne Tribe.
